Terms of Service

1. About these Terms

These Terms of Service ("Terms") govern your access to and use of Compendium (the "Service"), a streaming audiobook product ("Compendium," "we," "us"). By affirmatively agreeing when you create an account or begin a paid subscription, you accept these Terms and our Privacy Policy. If you don't agree, don't create an account or use the paid Service.

2. Who can use Compendium

You must be at least 13 years old to create a free account. To subscribe or provide a payment method you must be at least 18 and have the legal capacity to enter a binding agreement; if you are under 18, a parent or legal guardian must hold the paid account and accept these Terms on your behalf. By subscribing you represent that you meet these requirements.

3. Your account

You're responsible for keeping your password confidential and for everything that happens on your account. Tell us right away at support@compendium.audio if you suspect unauthorized access. Your account and subscription are for your personal use only. Do not share credentials, including with household members, or resell access.

4. What the Service is

Compendium offers narrated books. Some features and titles are available without an account; paid access may be required for other features. We may add, remove, or update titles at our discretion.

5. Subscription and billing

Subscription availability, pricing, billing frequency, renewal terms, trial terms, and cancellation options are presented before you subscribe and in your account. You can manage or cancel a subscription from your account page.

6. Acceptable use

You agree NOT to:

• Automate or scrape the Service, or download audio files in bulk for rehosting.
• Rebroadcast, podcast, or publicly perform our narrations — including on YouTube, podcast platforms, or social video — without our written permission.
• Use the Service for any unlawful purpose, to harass anyone, or to circumvent our access controls (paywalls, rate limits, authentication).
• Share your account credentials publicly or resell access.

We may suspend or terminate access for fraud, abuse, or repeated bad-faith conduct, subject to applicable law.

Your indemnity. To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Compendium and its members, officers, and contractors from any third-party claim, demand, loss, or expense (including reasonable legal fees) arising out of your misuse of the Service, your breach of these Terms, your violation of any law, or your rebroadcast, redistribution, or other unauthorized use of our narrations.

7. Intellectual property

• The Compendium name and logo, software, site designs, and original cover art are owned by us or licensed to us. Your subscription gives you a personal, non-exclusive, non-transferable, revocable license to stream the narrations for your own listening. No commercial, broadcast, or derivative rights are granted. Any rights in narrations may vary by jurisdiction.
• Feedback you send us is non-confidential; we can use it without owing you anything in return.

8. Modification and termination

We may modify or discontinue any part of the Service at any time, subject to applicable law. Canceling a subscription stops future renewal but keeps your account and listening history. To delete the account itself, email support@compendium.audio from the address associated with your account. See our Privacy Policy for what deletion covers and the records we may need to retain.

9. Disclaimers

The Service is provided "as is" and "as available." We don't promise it will be uninterrupted or error-free. To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section limits any warranty that can't be excluded under applicable consumer law.

10. Limitation of liability

To the maximum extent permitted by law, Compendium's total aggregate liability to you for any claim arising out of or relating to these Terms or the Service is limited to the total amount you paid us in the twelve months immediately before the claim. We are not liable for any indirect, incidental, consequential, special, or punitive damages — including lost profits, lost data, or lost goodwill — even if we've been advised of the possibility. Some jurisdictions don't allow these limits; in those places the limits apply to the maximum extent the law allows.

11. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-laws rules. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you and we consent to personal jurisdiction there. Either of us may bring a qualifying claim in small-claims court instead. Nothing in these Terms takes away rights or remedies that applicable consumer law does not allow you to waive.

12. Changes to these Terms

We may update these Terms; the latest version is always at /terms.html. Where required, we will provide notice of material changes. If a change requires your consent, we will ask for it before applying the change to your use of the Service.

13. Miscellaneous

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. These Terms (with our Privacy Policy) are the entire agreement between you and us about the Service. You can't assign these Terms to anyone else; we can assign them as part of a sale or reorganization.

Events beyond our control. We are not liable for any failure or delay in providing the Service caused by events beyond our reasonable control, including network failures, acts of God, or government action.

14. Copyright and rights complaints

If you believe a title, narration, or cover creates a rights concern, email support@compendium.audio with the title or URL and enough detail for us to understand your concern.
